Through this article, I explore the issue of tolerance in the Western thought from a rhetorical perspective. I assume that the 1948 Universal Declaration of Human Rights reflects the framework in which Europeans democracies argue and think today. Consequently, I analyze the Universal Declaration with the help of Toulmin’s model in order to put its backing into light, and compare it to the 1789 Declaration of the Rights of Man. This backing, I argue, echoes the contemporary vision of tolerance in (...) Western democracies. Afterwards, I therefore analyze the concept of tolerance in a multicultural world. This reflection comes within the scope of the current researches in rhetoric as they were launched by Perelman’s Treatise on Argumentation first published in 1958. Having inherited from the 19th-century renewed interests in linguistics and semiotics, the contemporary researches assume an evolutionary and anthropological perspective on rhetoric and argumentation, seen as natural activities of human beings. This discipline, notably developing in the school of Brussels in argumentation [See Danblon, Emmanuelle, La Fonction Persuasive, Paris: Armand Colin, 2002], inspires itself both from Aristotle’s works and from the cognitive movement in contemporary linguistics. It seeks to establish a link between the emergence of rationality and rhetoric and takes its grounds in cognitive sciences as well as anthropological studies, philosophy, logics and theories of emotions. At present, it addresses several issues such as the status of rationality, persuasion and the place of rhetoric and argumentation in contemporary societies. (shrink)

O pensador esclarece qual foi o contato de Merleau-Ponty com os manuscritos de Husserl, e que tipo de leitura, situada e complicada, ele realizou não apenas desses manuscritos, mas da obra de Husserl como um todo. Esse aspecto é particularmente importante (...) para os estudos de filosofia francesa contemporânea porque Merleau-Ponty foi um dos grandes responsáveis pela introdução de Husserl no pensamento francês. Tal esclarecimento permite mostrar a originalidade da filosofia de Merleau-Ponty, pois revela que o autor não era um exegeta de Husserl, mas um pesquisador inquieto e multifacetado, engajado nos debates intelectuais e políticos de sua época. Se ele não pode ser reduzido à figura de um mero leitor de Husserl, tampouco sua ontologia tardia pode ser resumida à influência de Heidegger. Debruçado sobre os manuscritos deixados inacabados por Merleau-Ponty em função de sua morte prematura, os quais eram um esboço de um novo livro, Saint Aubert realizou um minucioso trabalho de pesquisa dos usos que Merleau-Ponty faz de termos centrais de sua ontologia – chair, Leib, empiétement, quiasma – mostrando que eles não traduzem ou expressam literalmente conceitos provenientes de Husserl ou de Heidegger, pelo contrário, esses termos ganham uma gama de sentido multifacetada nos escritos de Merleau-Ponty, alimentando-se de suas leituras e meditações filosóficas, mas também de sua cultura científica e literária, e de suas preocupações éticas e políticas. A pesquisa de Saint Aubert, dedicada à interpretação dos chamados “inéditos” de Merleau-Ponty, resultou na publicação de cinco livros, pelas edições Vrin, todos eles guiados por uma leitura genética transversal da obra merleau-pontiana. Além disso, Saint Aubert, com a ajuda de outros pesquisadores e pesquisadoras, publicou, com apurado cuidado editorial, vários volumes com os manuscritos de Merleau-Ponty. Esse material, disponível de modo organizado e situado, é de uma riqueza incomparável, e permite dimensionar de modo mais preciso o papel de Merleau-Ponty no pensamento contemporâneo, além de iluminar o sentido de seu projeto ontológico. In this study I attempt to provide an answer to the question how the Babylonian scholars arrived at their mathematical theory of planetary motion. Although no texts are preserved in which the Babylonians tell us how they did it, from the surviving Astronomical Diaries we have a fairly complete picture of the nature of the observational material on which the scholars must have based their theory and from which they must have derived the values of the defining parameters. Limiting the (...) discussion to system A theory of the outer planets Saturn, Jupiter and Mars, I will argue that the development of Babylonian planetary theory was a gradual process of more than a century, starting sometime in the fifth century BC and finally resulting in the appearance of the first full-fledged astronomical ephemeris around 300 BC. The process of theory formation involved the derivation of long “exact” periods by linear combination of “Goal–Year” periods, the invention of a 360° zodiac, the discovery of the variable motion of the planets and the development of the numerical method to model this as a step function. Longitudes of the planets in the Babylonian zodiac could be determined by the scholars with an accuracy of 1° to 2° from observations of angular distances to Normal Stars with known positions. However, since the sky is too bright at first and last appearances of the planets and at acronychal rising for nearby stars to be visible, accurate longitudes as input for theoretical work could only be determined when the planets were near the stationary points in their orbits. In this study I show that the Babylonian scholars indeed based their system A modeling of the outer planets on planetary longitudes near stations, that their system A models of Saturn and Jupiter provided satisfactory results for all synodic phenomena, that they realized that their system A model of Mars did not produce satisfactory results for the second station so that separate numerical schemes were constructed to predict the positions of Mars at second station from the model at first station, and finally that their system A model for Mars provided quite poor predictions of the longitude of Mars at first and last appearances over large stretches of the zodiac. I further discuss ways in which the parameters of the system A models may have been derived from observations of the outer planets. By analyzing contemporaneous ephemerides from Uruk of four synodic phenomena of Jupiter from the second century BC, I finally illustrate how the Babylonian scholars may have used observations of Normal Star passages of planets to choose the initial conditions for their ephemerides. “Fair and equitable benefit-sharing” is one of the objectives of the UN Convention on Biological Diversity and the FAO International Treaty on Plant Genetic Resources for Food and Agriculture. In essence, benefit-sharing holds that countries, farmers, and indigenous communities that grant access to their plant genetic resources and/or traditional knowledge should share in the benefits that users derive from these resources. But what exactly is understood by “fair” and “equitable” in this context? Neither term is defined in the international treaties. (...) A complicating factor, furthermore, is that different motivations and perspectives exist with respect to the notion of benefit-sharing itself. This paper looks at six different approaches to benefit-sharing that can be extracted from the current debates on “Access and Benefit-Sharing.” These approaches form the basis of a philosophical reflection in which the different connotations of “fair and equitable” are considered, by analyzing the main principles of justice involved. Finally, the various principles are brought together in order to draw some conclusions as to how a fair and equitable benefit-sharing mechanism might best be realized. This paper concentrates on some aspects of the history of the analytic-synthetic distinction from Kant to Bolzano and Frege. This history evinces considerable continuity but also some important discontinuities. The analytic-synthetic distinction has to be seen in the first place in relation to a science, i.e. an ordered system of cognition. Looking especially to the place and role of logic it will be argued that Kant, Bolzano and Frege each developed the analytic-synthetic distinction within the same conception of scientific rationality, (...) that is, within the Classical Model of Science: scientific knowledge as cognitio ex principiis . But as we will see, the way the distinction between analytic and synthetic judgments or propositions functions within this model turns out to differ considerably between them. (shrink)

In this comment, a picture of ERP research is sketched that is slightly different from Hardcastle's account, in that it emphasises the functional characterisation of ERP components rather than the neurophysiological connections. It is suggested that selection pressure of ERP work on cognitive and neurophysiological theories and vice versa is a more apt metaphor for intertheoretical relations in this field than explanatory extension. Secondly, it is argued that the temporal characteristics of ERP components do not support Hardcastle's claim that they (...) may be used to fix timing in phenomenal consciousness. Although I agree that ERP components, cautiously interpreted, can contribute to the identification of substages of information processing, rather than refuting Dennett and Kinsbourne, her ERP data seem compatible with a multiple drafts model. Prenatal screening for foetal abnormalities such as Down's syndrome differs from other forms of population screening in that the usual aim of achieving health gains through treatment or prevention does not seem to apply. This type of screening leads to no other options but the choice between continuing or terminating the pregnancy and can only be morally justified if its aim is to provide meaningful options for reproductive choice to pregnant women and their partners. However, this aim should not be (...) understood as maximizing reproductive choice per se. Only if understood as allowing prospective parents to avoid suffering related to living with (a child with) serious disorders and handicaps can prenatal screening be a publicly or collectively funded programme. The alternative of moving prenatal testing outside the healthcare system into the private sector is problematic, as it makes these tests accessible only to those who can afford to pay for it. New developments in prenatal screening will have to be assessed in terms of whether and to what extent they either contribute to or undermine the stated aim of providing meaningful options for reproductive choice. In the light of this criterion, this article discusses the introduction of the new non‐invasive prenatal test (NIPT), the tendency to widen the scope of follow‐up testing, as well as the possible future scenarios of genome‐wide screening and ‘prenatal personalised medicine’. The article ends with recommendations for further debate, research and analysis. (shrink)

This study argues that contemporary theology needs a reconceptualised form of metaphysical theology to readdress this question of universality. In order to develop such a new metaphysical theology, de Jong turns to the work of Karl Rahner and Edward Schillebeeckx. Presenting a new perspective on their theological methods, he demonstrates that these theologians employ a dialectical interplay of hermeneutical and metaphysical arguments yielding a modest theological metaphysics. Crucially, these thinkers recognise that acknowledging hermeneutical conditions does not need to end in (...) particularism. Instead, Rahner and Schillebeeckx argue that the infinite variety of particular human experiences can act as potential encounters with the universally self-revealing God. Retrieving these modest forms of theological metaphysics reminds contemporary theology that it is possible to think about universality from within particularity. Balancing the intelligible and mysterious nature of God, Rahner and Schillebeeckx show how a modest theological metaphysics contains its own self-critical hermeneutical disciplining. This renewed understanding about the earlier use of metaphysics opens up new avenues of thought for fundamental theologians that do not want to shy away from the difficult question of the universality of God. This paper analyses the relationship between Hobbes's theory of language and his theory of science and method. It is shown that Hobbes, at least in his Computatio sive Logica (1655), deviates in some measure from the traditional (Aristotelian) model of language. In this model speech is considered to be a fairly unproblematic expression of thought, which itself is independent of language. Basing himself on a nominalist account of universals, Hobbes states that the demonstration or assertion of universal propositions presupposes speech (...) The advent of new genetic and genomic technologies may cause friction with the principle of respect for autonomy and demands a rethinking of traditional interpretations of the concept of informed consent. Technologies such as whole‐genome sequencing and micro‐array based analysis enable genome‐wide testing for many heterogeneous abnormalities and predispositions simultaneously. This may challenge the feasibility of providing adequate pre‐test information and achieving autonomous decision‐making. At a symposium held at the 11th World Congress of Bioethics in June 2012 (Rotterdam), organized by (...) the International Association of Bioethics, these challenges were presented for three different areas in which these so‐called ‘new genetics’ technologies are increasingly being applied: newborn screening, prenatal screening strategies and commercial personal genome testing. In this article, we build upon the existing ethical framework for a responsible set‐up of testing and screening offers and reinterpret some of its criteria in the light of the new genetics. As we will argue, the scope of a responsible testing or screening offer should align with the purpose(s) of testing and with the principle of respect for autonomy for all stakeholders involved, including (future) children. Informed consent is a prerequisite but requires a new approach. We present preliminary and general directions for an individualized or differentiated set‐up of the testing offer and for the informed consent process. With this article we wish to contribute to the formation of new ideas on how to tackle the issues of autonomy and informed consent for (public) healthcare and direct‐to‐consumer applications of the new genetics. Gestures and speech are clearly synchronized in many ways. However, previous studies have shown that the semantic similarity between gestures and speech breaks down as people approach transitions in understanding. Explanations for these gesture–speech mismatches, which focus on gestures and speech expressing different cognitive strategies, have been criticized for disregarding gestures’ and speech's integration and synchronization. In the current study, we applied three different perspectives to investigate gesture–speech synchronization in an easy and a difficult task: temporal alignment, semantic similarity, and (...) complexity matching. Participants engaged in a simple cognitive task and were assigned to either an easy or a difficult condition. We automatically measured pointing gestures, and we coded participant's speech, to determine the temporal alignment and semantic similarity between gestures and speech. Multifractal detrended fluctuation analysis was used to determine the extent of complexity matching between gestures and speech. We found that task difficulty indeed influenced gesture–speech synchronization in all three domains. We thereby extended the phenomenon of gesture–speech mismatches to difficult tasks in general. Furthermore, we investigated how temporal alignment, semantic similarity, and complexity matching were related in each condition, and how they predicted participants’ task performance. Our study illustrates how combining multiple perspectives, originating from different research areas (i.e., coordination dynamics, complexity science, cognitive psychology), provides novel understanding about cognitive concepts in general and about gesture–speech synchronization and task difficulty in particular. Automated technologies and robots make decisions that cannot always be fully controlled or predicted. In addition to that, they cannot respond to punishment and blame in the ways humans do. Therefore, when automated cars harm or kill people, for example, this gives rise to concerns about responsibility-gaps and retribution-gaps. According to Sven Nyholm, however, automated cars do not pose a challenge on human responsibility, as long as humans can control them and update them. He argues that the agency exercised in (...) automated cars should be understood in terms of human–robot collaborations. This brief note focuses on the problem that arises when there are multiple people involved, but there is no obvious shared collaboration among them. Building on John Danaher’s discussion of command responsibility, it is argued that, although Nyholm might be right that autonomous cars cannot be regarded as acting on their own, independently of any human beings, worries about responsibility-gaps and retribution-gaps are still justified, because it often remains unclear how to allocate or distribute responsibility satisfactorily among the key humans involved after they have been successfully identified. The Movement of Showing investigates the idea, shared by Derrida, Hegel and Heidegger, that the value of their thought is not found in its results or conclusions, but in its "movement." All three describe the heart of their work in terms of a pathway, development, or movement rather than in terms of its propositions or conclusions. This seems to deprive their thought of a solid ground, and indeed deconstruction in particular is often criticized in this way. Johan de Jong argues (...) that this is a structural vulnerability that is both its weakness and the source of its value, tracing Derrida's indirect method from his early to later works, and considering his engagements with Hegel and Heidegger. His analysis locates an affinity among Hegel, Heidegger and Derrida in a shared distrust of externality and, against the grain of some Levinasian commentaries, argues that Derrida's indirectness results in an ethics of complicity. The Movement of Showing answers a central question that many polemics about continental philosophy and postmodernism revolve around concerning how, methodologically, one can philosophize responsibly. It shows the difference between critique and polemics, and why simply taking up a position for or against is insufficient in order to think responsibly. (shrink)

Een poging om de geschiedenis van een denkwijze door de eeuwen heen, in dit geval die van het schema van “het midden- en middellijkheidsdenken” , resp. het “denken in termen van ‘midden’ en ‘bemiddeling’” , kritisch in kaart te brengen valt op het eerste gezicht onder het genre Ideengeschichte of history of ideas. Zeker wanneer men ideeëngeschiedenis enerzijds enger, maar anderzijds daarbinnen weer breder opvat dan de invulling die Arthur Lovejoy daaraan gaf in zijn bekende The Great Chain of Being (...) .Het enerzijds betreft de inperking tot het terrein van de filosofie. Het anderzijds raakt hetgeen als idea wordt geaccepteerd. Lovejoy spreekt over ideeën vaak als “unit ideas” en vergt dat deze eenvoudig en ook enkelvoudig zijn. Ik zou in de ideeëngeschiedenis ook ruimte willen maken voor meer complexe filosofische noties, schema’s en zelfs filosofische theorieën. Wel lijkt me dat moet worden vastgehouden aan de eis dat deze ideeën naspeurbaar zijn door filosofische stromingen heen en dat zij bij voorkeur een zekere breedheid vertonen, ook in de zin van toepassing blijken te vinden in meerdere deelgebieden van de filosofie. En hier zij alvast maar genoteerd dat ook Van der Hoeven Lovejoy en diens studie noemt. (shrink)

And to imagine, is to see.”Perception and Imaginary in Merleau-PontyMerleau-Ponty accords such a phenomenological and ontological priority to perception that this privilege might lead him to minimize the importance of theimaginary in our relationship with the world. In fact, in the work published during his life, the theme of the imaginary does not occupy a large place, and its conceptual elaboration remains little visible. A reading of his posthumous publications and of his unpublished papers leads (...) to a more subtle landscape, inwhich the philosopher destabilizes our common oppositions between real and imaginary, as well as those between the imaginary and truth. From themanuscripts from the end of the 1940s on, Merleau-Ponty expands his inquiry into perception in two complementary directions: the intuition of a form of coextensivity between perceptive life and imaginary life, but also between perception and expression. These intuitions, never disavowed, would continueto deepen up through the late unpublished ontological works. They find a guiding thread in the contestation of Sartre’s separation between the real andthe imaginary, and they open out onto the outline of a complex link between truth, imagination, and expression. Merleau-Ponty pretended to approve of thework of The Imaginary all that which is actually moving beyond it, in the direction most opposite to this essay’s own aims: “To see is to imagine. And toimagine is to see.” This split with Sartre finds one of its pivots in the phenomenological characterization of vision as a surpassing of the observable, a surpassing that would touch on an essential dimension of being and of truth.“Vedere è immaginare. Merleau-Ponty finge di “ratificare” il lavoro de L’Immaginario, in realtà sorpassandolo nelladirezione il più possibile opposta allo sforzo compiuto da questo stesso saggio: «edere è immaginare. E immaginare è vedere». Questo distanziarsi da Sartretrova uno dei suoi “cardini” nella caratterizzazione fenomenologica della visione come superamento dell’osservabile, un superamento che riguarderebbeuna dimensione essenziale dell’essere come della verità. Prenatal screening pathways, as nowadays offered in most Western countries consist of similar tests. First, a risk‐assessment test for major aneuploides is offered to pregnant women. In case of an increased risk, invasive diagnostic tests, entailing a miscarriage risk, are offered. For decades, only conventional karyotyping was used for final diagnosis. Moreover, several foetal ultrasound scans are offered to detect major congenital anomalies, but the same scans also provide relevant information for optimal support of the pregnancy and the delivery.Recent developments (...) in prenatal screening include the application of microarrays that allow for identifying a much broader range of abnomalities than karyotyping, and non‐invasive prenatal testing (NIPT) that enables reducing the number of invasive tests for aneuploidies considerably. In the future, broad NIPT may become possible and affordable.This article will briefly address the ethical issues raised by these technological developments. First, a safe NIPT may lead to routinisation and as such challenge the central issue of informed consent and the aim of prenatal screening: to offer opportunity for autonomous reproductive choice. Widening the scope of prenatal screening also raises the question to what extent ‘reproductive autonomy’ is meant to expand. Finally, if the same test is used for two different aims, namely detection of foetal anomalies and pregnancy‐related problems, non‐directive counselling can no longer be taken as a standard. Our broad outline of the ethical issues is meant as an introduction into the more detailed ethical discussions about prenatal screening in the other articles of this special issue. (shrink)

The legitimacy of the dominant intensive meat production system with respect to the issue of animal welfare is increasingly being questioned by stakeholders across the meat supply chain. The current meat supply is highly undifferentiated, catering only for the extremes of morality concerns (i.e., conventional vs. organic meat products). However, a latent need for compromise products has been identified. That is, consumer differences exist regarding the trade-offs they make between different aspects associated with meat consumption. The heterogeneity in consumer demand (...) could function as a starting point for market segmentation, targeting and positioning regarding animal welfare concepts that are differentiated in terms of animal welfare and price levels. Despite this, stakeholders in the meat supply chain seem to be trapped in the dominant business model focused on low cost prices. This paper aims to identify conflicting interests that stakeholders in the meat supply chain experience in order to increase understanding of why heterogeneous consumer preferences are not met by a more differentiated supply of meat products produced at different levels of animal welfare standards. In addition, characteristics of the supply chain that contribute to the existence of high exit barriers and difficulty to shift to more animal-friendly production systems are identified. Following the analysis of conflicting interests among stakeholders and factors that contribute to difficulty to transform the existing dominant regime, different routes are discussed that may help and motivate stakeholders to overcome these barriers and stimulate the creation of new markets. Mediation is a process in which two parties agree to resolve their dispute by negotiating over alternative solutions presented by a mediator. In order to construct such solutions, the mediator brings more information and knowledge, and, if possible, resources to the negotiation table. In order to do so, the mediator faces the challenge of determining which information is relevant to the current problem, given a vast database of knowledge. The contribution of this paper is the automated mediation machinery to resolve (...) this issue. We define the concept of a Mediation Problem and show how it can be described in Game Description Language. Furthermore, we present an algorithm that allows the mediator to efficiently determine which information is relevant to the problem and collect this information from the negotiating agents. We show with several experiments that this algorithm is much more efficient than the naive solution that simply takes all available knowledge into account. (shrink)

Bacteria have developed an impressive ability to survive and propagate in highly diverse and changing environments by evolving phenotypic heterogeneity. Phenotypic heterogeneity ensures that a subpopulation is well prepared for environmental changes. The expression bet hedging is commonly (but often incorrectly) used by molecular biologists to describe any observed phenotypic heterogeneity. In evolutionary biology, however, bet hedging denotes a risk‐spreading strategy displayed by isogenic populations that evolved in unpredictably changing environments. Opposed to other survival strategies, bet hedging evolves because the (...) selection environment changes and favours different phenotypes at different times. Consequently, in bet hedging populations all phenotypes perform differently well at any time, depending on the selection pressures present. Moreover, bet hedging is the only strategy in which temporal variance of offspring numbers per individual is minimized. Our paper aims to provide a guide for the correct use of the term bet hedging in molecular biology. (shrink)
